I read that the minister’s decision is final. It’s not contestable unless Kelly uses another loophole.

I don’t know how he could win this. The other two who tried for the same exemption had their visas cancelled. Judge Kelly would set an awful example if he gave Novak a pass. Novak went one step further and signed off on a visa with inaccurate information. I would think a ruling in Novak’s favor would set up for a series of court challenges from other people who saw their visas cancelled depending on the grounds.
Yep, I've read opinions by serious immigration lawyers. This hearing is different that the previous one (where it was easy to win on the procedural grounds) and Joker's options are very limited. Judge Kelly seemed to be very compassionate in his previous hearing though, so he will be looking for a loophole. Nothing in black & white in real life. so Kelly may still find something that we all (including Minister Alex) forgotten about...

Is it that Tiley wanted Novak to win the record-breaking 21st major in Australia, and was willing to do anything to make that happen? It seems that was his motivation.

Djokovic will stay out of detention tonight.Djokovic will meet with Immigrations officals tomorrow for an interview
Government lawyers want the case transferred to a higher court.
Note Judge Kelly says that the issues of a valid medical exemption according to ATAGI,was never dealt with in the Djokovic hearing on Monday."That part of the case remains unresolved".

Djokovic is a foreign traveler, and he made a false statement on his immigration form. On top of that, his grounds for medical exemption didn't conform to Australian statutes. On top of that, there is some question about the veracity and timeline of his covid tests, and he definitely poses a heath risk, as he defied even his own country's isolation mandates. The international disgrace is Novak's. Let's see if they actually get him out, though, or if his fancy lawyers prolong this enough to let him play.

The victorian government and tennis australia granted him the exemption, djokovic followed the rules. This is australia’s disgraceful and incompetence that created this, not djokovic.. all the had to do is tell him no from the beginning

djokovic isn’t a threat to anyone, vaccinated people are spreading covid.. as a matter of fact

this is 100% political, morrison government is worried about elections..

the treatment of this man is disgraceful and even you should be ashamed of yourself, acting as if djokovic did terrible things. He has done nothing but follow rules which australia has botched and he is no public health threat. Disgusting what australia has done and behavior by people treating him as if he committed some felony or something.. shameful behaviour by australia and the covid crazed people

Well that'll be discussed in court, and if he did nothing, he'll be released. But there are good reasons why he ended up in court, and may still get into heavy trouble: lying on his visa application, missing the deadline for a medical exemption, making a false claim for medical exemption, breaking isolation when he knew he had Covid, this one could be used on character grounds. There are suspicions about the validity of his positive test, though these might be groundless. Even the Serbian government say he's in trouble over treating his positive test as something he needn't be concerned about.

Looking at it objectively, he's given them little option to at least examine his bona fides, which as the judge himself just said, "that part of the case remains unresolved."

It's irrelevant if he's not a danger to anyone, although he was a danger to people when he broke isolation, but that didn't matter to him one little bit...

I dont Hate Novak Djokovic for starters.I am in the medical profession and work in ICU with COVID patients for 2 years,I invite you to come with me and see these people on ventilators,I have lost young people,people that are fit and healthy with no underlying issues.We have a strict policy here in Australia,they are the Rules.I have always respected Novak's views on vaccine,though if he wanted to come he and play he has to be vaccinated.

Listen, I'd defend him to the hilt on his vaccine stance. Go down and look in the Covid thread and you'll find opinions there. None of this is relevant to the case he's facing. You have to separate your fandom and look at the situation objectively.

And by the way, I've heard that Rafa may have entered Australia too early after having Covid. If so, that should be investigated also..
