"Djokovic's experience at the airport upon arrival in Australia is likely to prove key to his case.
A tired and confused Djokovic claims that he asked for extra time to speak to his agent and his lawyers and that his request was granted before he was woken up at 6am and urged to agree to the visa cancellation as it was in his best interest to do so.
His legal team say this advice was "spurious" and "manifestly unjust".
It is being argued that this treatment by border officials when he arrived in Melbourne was unfair and, if deemed to be so, could be the basis of him winning the verdict."

Wow. In the name of every person who has ever been mistreated by authorities, and have had that held against them, anyway, this CERTAINLY would be preferential treatment, if these are the grounds. I'm pretty sure that translates internationally.
I posted what Judge Kelly replied to that notion of our Border Force officials....go back and read it.

You have to admit there was confusion going on here! There was no agreement or certaincy of any kind between the different entities deciding! :facepalm:
If Novak was vaccinated,there would be no problem,TA has tried everything to allow Novak to play,regardless of the Federal law.

Wouldn’t Federal law take precedent over everything despite what a botch by TA and the State as far as exemption status and paperwork. Regardless of anything else confusion or no, the Federal government’s conditions need to be met period before it goes to the State level, and then TA.

Craig Tiley will have to go into overdrive to clear this mess up.just before the AO....it is sad it has come to a court hearing.
Rules are rules,we have to follow them,regardless.Even though at times they can be harsh.

Personally, I think Djokovic and Tiley were banking on this confusion to get him an in to the tournament. I don’t think there was any doubt in Djokovic’s or Tiley’s minds that a mess was going to happen.

One would think. And there is a judge involved. He may decide even today.
From what I am hearing from a reporter in Melbourne this could go into the night,as Government has just started their case.
Decision maybe tomorrow

I most certainly agree which is why when I travel I try to be on the right side of it. I most certainly try to have my paperwork in order and have every document known to mankind on me in the event of an issue.

I think even if Djokovic wins this, he’s lost. He definitely built a cloud over his year which I don’t think there is any way for him to get around. Whenever you think Djokovic is actually going to take a step forward, he takes like 5 steps back.

This is an open and shut case. Regardless of who said or did what, Djoke can’t be in Melbourne because he isn’t vaccinated. The judge is falling for the confusion being created. Rather disappointing for someone supposedly erudite.

I don’t know what he was confused about it isn’t like he doesn’t know his Federal government’s rules. He should be responsible for repaying Djokovic’s legal fees should Djokovic win.
He was just in 'damage control' that is all,if he read the Federal Health Letter from our Health federal minister Greg Hunt last November,this court case would not be happening....actually there were 2 letters sent.

This is what I have been arguing all along: that the onus falls on the traveler. And even with @kskate2's story above about going to China, and trying to be pro-active about getting the right visas, then getting bad intel from the cruise company. It worked out, in the end, but she spent a lot of lost time in immigration. And immigration has no reason to sympathize with the fact that someone told you the wrong thing. If it's a simple mix-up, you might get lucky. But, if you were on the wrong side of the statutes, that's another. Djokovic's lawyers don't seem to be arguing that he was correct on the law, only that he was misused by the confusion between government entities. That seems a fine-point that should fly, with some stickler for the law.

Then why do cops fall back on that excuse all the time when nailed in court by the lamest of defense attorneys? There's plenty of innocent people detained or arrested due to ignorance of the law by law enforcement! Happens all the time and every day here in the States! It's on video and in the news everyday due to cameras everywhere to dispute "testi-lying cops!" :pleading-face: :sick::anxious-face-with-sweat::facepalm:
